Marriage License

Requirements for a marriage license vary from state to state and different stipulations could also be included on a county level.  Take the time to see what restrictions apply to you. This is the one document you don’t want to forget or leave to the last minute, it's what makes it legal.

State Requirements
If you plan to marry in the state of California, the following restrictions may apply:

Age Requirement:  If over the age of 18 years, parental consent is not required to marry.  A birth certificate may be required to show proof of age.

Under Age 18:  If either applicant is under the age of 18, you will be required to have a parent or legal guardian present.  It will also be necessary to bring a copy of your birth certificate.  An appointment with a counselor will then be required, followed by an appearance before a superior court judge.

Residency:  You do not have to be a previous or current resident in the state of California to obtain a marriage license statewide.

Waiting Period:  There is no set waiting period.  A license will be issued immediately and you can marry any time after it has been issued.

Blood Test:  No blood test or physical exam is required in California.

Expiration:  The license will expire 90 days after it has been issued.  If you wait longer than 90 days to get married, another license will need to be purchased.

Divorced or Widowed Applicants:  Date of the divorce or date of spouse’s death will be required.  If either has occurred within the last 90 days, a copy of the divorce decree or death certificate will also be required.

County Requirements- Cost and Where to Get One
Requirements for a marriage license and cost vary by county.  In the majority of locations, both applicants must be present at the time of application.  A valid driver’s license or DMV issued ID card is also required.  If neither document is available, you must provide a copy of your birth certificate and an acceptable form of identification with a picture.
